Welcome to Macha. These Terms of Service ("Terms") are a binding agreement between you and Macha ("Macha," "we," "us," or "our") that governs your access to and use of the Macha mobile application, website, and related services (collectively, the "Service"). Please read them carefully. Macha is a futuristic, video-first, vibes-based social platform where people share short videos, go live, build communities, and connect.
By accessing, downloading, registering for, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with any part of these Terms, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You must be at least 13 years old to create an account or use the Service. If you are under the age of 18 (or the age of legal majority where you live), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
By using the Service, you represent and warrant that you meet these age requirements, that all registration information you submit is truthful and accurate, and that you are not barred from using the Service under the laws of your jurisdiction. We may, in our sole discretion, refuse, suspend, or terminate access to anyone who does not meet these eligibility requirements.
Macha is a video-first, vibes-based social platform. The Service helps you express yourself, discover content, and connect with communities. Its core features include:
We are continually evolving the Service and may add, change, or remove features at any time. Some features may be offered as part of beta or experimental programs and may not function perfectly.
To access most features you must create an account, which you may do using Google sign-in (OAuth). You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
Notify us immediately at machasupport@gmail.com if you suspect any unauthorized access to or use of your account. You are responsible for maintaining the confidentiality of your login. You may delete your account at any time, which is described in the "Termination and Suspension" section below.
"User Content" means anything you create, upload, post, broadcast, stream, send, or share through the Service, including videos, reels, photos, Stories, live broadcasts and their recordings or replays, captions, comments, direct messages and voice notes, attached audio or sounds, and content you share into Macha from other apps.
You retain ownership of your User Content. You are solely responsible for your User Content and for the consequences of posting or sharing it. You represent and warrant that you own or have all rights, licenses, and permissions necessary to share your User Content and to grant the license below, and that your User Content does not violate these Terms or any law or the rights of any third party.
By making User Content available through the Service, you grant Macha a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, modify (for technical purposes such as reformatting or transcoding), adapt, publish, publicly perform, publicly display, and distribute your User Content — including your videos, live streams, and replays — solely for the purposes of operating, providing, improving, and promoting the Service. This includes, for example, delivering your content to your chosen audience, generating thumbnails and previews, and featuring content within the app or in Macha marketing where permitted.
This license ends when you delete your User Content or your account, except that: (a) residual copies may persist in routine backups for a limited period before being overwritten; and (b) copies that have already been shared, reposted, or saved by other users, or that we are required to retain for legal, safety, or evidentiary reasons, may continue to exist. You also grant other users a license to access and interact with your User Content through the features the Service makes available (for example, viewing a public post or watching a replay).
Macha is built for creative, respectful, and safe expression. As a condition of using the Service, you agree that you will not:
We may remove content, restrict features, and suspend or terminate accounts that violate these rules, with or without notice.
When you go live, your broadcast is visible to others according to the visibility you choose (for example, public, tribe, exclusive, or invite-only). Live broadcasts may be recorded and offered as replays that others can watch later, subject to your visibility settings and these Terms.
You are responsible for everything you broadcast. You must stream lawfully, comply with all applicable laws and these Terms, and obtain any consents required to feature other people, locations, music, or copyrighted material in your broadcast. We may interrupt, end, remove, or refuse to host any live stream or replay that violates these Terms or that we believe poses a risk to safety.
Guap is an in-app virtual currency that you can earn and spend within Macha through activity and engagement. Guap exists only inside the Service and is provided to you under a limited, personal, non-transferable, revocable license to use within the Service.
Guap has no real-world monetary value, is not redeemable for cash or any item of monetary value, and is not transferable outside Macha. Guap is not a payment instrument, deposit, security, or legal tender of any kind. You do not own Guap, and balances may be adjusted, expired, reset, or revoked at any time — including to address fraud, abuse, farming, or errors, or otherwise at our discretion or in connection with changes to the Service. We are not liable for any loss of Guap.
We use a combination of automated systems, community reporting, and human review to keep Macha safe. You can report any post, profile, comment, message, or live stream using the in-app report button. For child-safety concerns you may also email machasupport@gmail.com (subject "CSAE Report") or contact the NCMEC CyberTipline directly.
We may, but are not obligated to, monitor, review, restrict, remove, or disable access to any User Content at our discretion. We may take action against accounts for violations of these Terms, including removing content, limiting features, suspending accounts, and reporting unlawful activity to the appropriate authorities. For more detail on how we protect children, see our Child Safety Standards.
The Service itself — including the Macha application and website, its source code, software, designs, user interface, graphics, logos, the "Macha" name, and all related trademarks, trade dress, and branding (but excluding User Content) — is owned by Macha and its licensors and is protected by intellectual property laws worldwide. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. Nothing in these Terms transfers any ownership of our intellectual property to you, and you may not use our trademarks or branding without our prior written consent. To be clear, Macha does not claim ownership of your User Content.
You may stop using the Service at any time. You can permanently delete your account directly in the app via Settings → "Delete Account"; this process is also documented at our account deletion page. Deleting your account is permanent.
We may suspend or terminate your access to all or part of the Service, with or without notice, if we believe you have violated these Terms or the law, to protect the safety of users or the integrity of the Service, or as otherwise permitted by law. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination — including User Content licenses you granted for already-shared copies, intellectual property, disclaimers, limitation of liability, and governing terms — will survive.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any content (including User Content created by others) is accurate, lawful, or reliable. You use the Service, and rely on any content, at your own risk.
To the maximum extent permitted by applicable law, in no event shall Macha, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to (a) your access to, use of, or inability to access or use the Service; (b) any conduct or content of any third party or other user on the Service, including any defamatory, offensive, or illegal content; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Service is limited to the greater of the amount you paid us, if any, in the twelve months preceding the claim, or one hundred U.S. dollars (USD $100).
We may update these Terms from time to time to reflect changes to the Service, our practices, or applicable law. When we make material changes, we will update the "Effective Date" above and, where appropriate, provide additional notice within the app. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
These Terms, together with our Privacy Policy and Child Safety Standards, constitute the entire agreement between you and Macha regarding the Service and supersede any prior agreements. If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
